2. Product Description

SmileDrive offers the SmileDrive OBD2 AI-powered fuel economy device ("Product"), a plug-and-play adapter that connects to your vehicle's OBD2 port to analyze and optimize fuel consumption. The Product is compatible with most gasoline and diesel vehicles manufactured after 1996 (OBD2-equipped).

Fuel savings results (up to 15%) are estimates based on aggregate user data and real-world testing. Individual results may vary depending on driving habits, vehicle make and model, and road conditions. SmileDrive does not guarantee specific fuel savings for any individual customer.

3. Pricing

All prices are displayed in your local currency where available, otherwise in US Dollars (USD). Prices are subject to change without notice. The price charged at the time of purchase is final. Applicable taxes may be added at checkout depending on your location.

4. Payment

All payments are processed securely through Stripe, a PCI-compliant payment processor. We accept major credit and debit cards including Visa, Mastercard, and American Express. By providing your payment information, you authorize SmileDrive to charge the total order amount to your payment method.

In the event of a failed payment, your order will not be fulfilled. SmileDrive is not responsible for charges or fees imposed by your bank or card issuer.

5. Shipping & Delivery

We ship worldwide. Shipping options, estimated delivery times, and costs are presented at checkout. SmileDrive is not responsible for delays caused by customs, shipping carriers, or events outside our control. Title and risk of loss pass to you upon delivery to the carrier. 6. Returns & Refunds

We offer a 14-day satisfaction guarantee. If you are not satisfied with your purchase, you may return the Product in its original condition within 14 days of delivery for a full refund. Return shipping costs are the responsibility of the customer. For full details, see our Returns Policy.

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of SmileDrive Inc. and is protected by applicable intellectual property laws. SMILEDRIVE DOES NOT WARRANT THAT THE PRODUCT WILL MEET YOUR SPECIFIC REQUIREMENTS OR THAT IT WILL PRODUCE ANY SPECIFIC FUEL SAVINGS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SMILEDRIVE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR PRODUCTS OR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within New Castle County, Delaware, for the resolution of any disputes.

12. Dispute Resolution

Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at support@smiledrive.com. We will make reasonable efforts to resolve disputes amicably within 30 days.

If informal resolution fails, any dispute shall be resolved by binding arbitration in Albuquerque, New Mexico, under the rules of the American Arbitration Association (AAA), rather than in court, except that you may bring claims in small claims court if your claims qualify.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. The date at the top of this page will reflect the date of the latest revision. Your continued use of our website or products after changes are posted constitutes your acceptance of the revised Terms.
